South Africa has no national online betting licence. Instead, nine provincial boards license bookmakers, and a bookmaker licensed in one province can accept online bets from customers across the country. According to ChampsBase, Betway holds two of these licences: 10181496-012 from the Western Cape Gambling and Racing Board and 9-2-1-09658 from the Mpumalanga Economic Regulator. Holding licences from two provinces makes Betway one of the best-regulated online bookmakers in the country. With a free bet, you keep the winnings but not the stake. A R10 free bet at odds of 3.00 that wins returns R20, not R30. Reviewers also note that cashing out your balance can void unused free bets, so use the free bet before withdrawing.

Betway’s South African site also offers casino-style games, such as slots and crash games, framed as bookmaker bets on “contingencies”. We don’t review or recommend these products, because their legal status is disputed:

• The law: Section 11 of the National Gambling Act, 2004 prohibits unauthorised interactive games, which covers online casino.
• The court: on 21 October 2025, the Supreme Court of Appeal ruled in the Supabets case that Gauteng-licensed bookmakers may not offer fixed-odds bets on casino games such as roulette, because the Gauteng Gambling Act only allows bets on sporting events.
• The National Gambling Board: says the ruling’s implications extend to all bookmakers across the country, has called on bookmakers to stop offering casino-style games as contingency betting, and has warned that winnings from interactive gambling will be confiscated.
• Betway’s position: Betway says it remains licensed by the relevant provincial boards, that the ruling was a narrow interpretation of the Gauteng Act, and that it “does not amount to a ban on online betting”.

Until the courts, the provinces or the new national gambling Bill settle the question, we think South African players are best served by sticking to sports and horse racing betting, which are clearly legal with a licensed bookmaker.

Unlocking the welcome free bet

You register on a Monday and deposit R50. By the following Monday, you place R50 on a five-leg multi with total odds of 3.40. Even if the multi loses, you receive the R10 free bet, which you can use any time in the next 180 days.

Using the free bet

You place your R10 free bet at odds of 2.50. If it wins, the total return would be R25, but the R10 free stake isn’t returned, so you receive R15.

Partial cash out

Your R100 multi is offered a R300 cash-out with one leg left. A partial cash out lets you take, say, R150 now and leave the rest of the bet running, so you lock in profit while keeping some upside.

Sports and horse racing betting are legal in South Africa with a licensed bookmaker, and you must be 18 or older. Here’s how the system works.

Provincial licences, national rules

The National Gambling Board, an agency of the Department of Trade, Industry and Competition, oversees the sector and keeps national registers, while nine provincial boards issue bookmaker licences, collect gambling taxes and supervise operators. At 31 March 2025, the National Gambling Board counted 315 licensed bookmakers, retail and online combined.

Online casino isn’t licensed

Section 11 of the National Gambling Act, 2004 prohibits unauthorised interactive games. A 2008 amendment that would have licensed interactive gambling never came into operation. Under the Act, playing at an unlicensed online casino is itself an offence, and penalties for illegal gambling can reach R10 million, ten years in prison, or both.

Changes on the way

The National Gambling Policy Council has resolved to fast-track a new national gambling Bill to bring national and provincial rules into line, expected at Cabinet later in 2026. The National Gambling Board has also invited proposals for a system to monitor and block illegal gambling websites, announced a partnership with the Advertising Regulatory Board on 17 September 2026 to monitor gambling adverts, and in August 2026 a national Illegal Gambling Task Team began operations in Limpopo.

No tax on your winnings

Recreational bettors don’t pay tax on betting winnings in South Africa. A 15% withholding tax proposed in 2011 was never introduced. Bookmakers pay provincial gambling taxes instead: in the Western Cape, a 3% tax plus a 3% betting levy on winning bets. National Treasury floated a 20% national tax on online gambling revenue in November 2025, which would be paid by operators rather than deducted from winnings; it wasn’t among the key proposals in the draft tax bills published on 30 July 2026.
